The Legal Framework of Asset Recovery: Working With Law Firms Worldwide

Intelligence finds assets; law recovers them. Understanding the legal framework — freezing orders, disclosure orders, enforcement — is essential to turning intelligence into recovered funds.

DigitalBank Intelligence's analysis: Intelligence finds assets; law recovers them. Understanding the legal framework — freezing orders, disclosure orders, enforcement — is essential to turning intelligence into recovered funds.

Intelligence and law are two halves of recovery

A common misconception is that intelligence alone recovers assets. It does not. Intelligence finds the asset, attributes it to a beneficiary, and produces the evidence. Law then takes that evidence and converts it into a legally enforceable recovery. Without both halves, neither works.

Our role is the intelligence half. We produce findings intended for lawful use — handed to your lawyers to drive the legal process. Understanding how that legal process works helps you understand why intelligence must be conducted the way we conduct it.

The legal instruments of recovery

Freezing orders (Mareva / worldwide)

A freezing order prevents the target from moving or dissipating assets while litigation proceeds. Obtained ex parte (without notice to the target) in most jurisdictions, it is the single most powerful tool in civil recovery — but it requires evidence sufficient to satisfy the court that assets exist and are at risk. That evidence is what our intelligence produces.

Disclosure orders

A disclosure order compels a third party — typically a bank — to reveal information about a target's accounts. This is how an identified account becomes an identified account holder. Disclosure orders bridge the gap between intelligence and legal attribution.

Enforcement

A judgment is paper until it is enforced. Enforcement mechanisms vary by jurisdiction but include garnishment of accounts, seizure of assets, and appointment of receivers. Enforcement requires knowing where the assets are — again, the product of intelligence.

Why lawful intelligence matters legally

Intelligence obtained unlawfully may be inadmissible — and worse, may expose the pursuing party to liability. This is why every operation we conduct is verified for compliance with applicable local law by top-tier counsel in the relevant jurisdiction. Lawful intelligence is not only ethical; it is what makes the evidence usable in court.

The coordination model

A recovery engagement typically involves three parties working in sequence:

  1. —The intelligence firm (us) — traces, attributes, and produces evidence.
  2. —Your lawyers — use the evidence to obtain freezing, disclosure, and enforcement orders.
  3. —Local counsel in each jurisdiction — handles the specific legal actions their jurisdiction requires.

We coordinate across all three, ensuring that intelligence is produced in a form your lawyers can use, on a timeline that supports the legal strategy.

The honest limit

Not every case results in recovery. Some assets are held in forms or jurisdictions that resist legal action. Some evidence, however strong, cannot overcome jurisdictional barriers. We tell you what is achievable before you commit — because our fee is contingent on success, we have no incentive to overstate.

When to engage

The earlier intelligence begins, the more effective the legal action. Assets that are found before they are moved can be frozen before they vanish. If you are contemplating litigation involving concealed or misappropriated assets, engage intelligence early — not after the legal process has stalled.
